Dian Boyer-Vine, the lawyer for the California State Legislature opined that the Governor exceeded his authority when he issues an executive order imposing “the most aggressive carbon-emission reductions in North America.”  The order was meant to bring our state in line with the European Union’s aggressive climate change mandates.

The opinion by Legislative Counsel Diane Boyer-Vine does not curtail Brown’s authority to continue implementing the greenhouse gas reduction plan, but it suggests a lawsuit challenging them could be successful.  Boyer-Vine opines that only the Legislature can mandate a carbon-reduction regime that is tougher than those set by AB 350 which was signed into law in 2006.

For now, this is just an interesting development in the continuous effort to regulate greenhouse gases in the state, but it is being analyzed closely as it could tip the balance in legal action brought against the state.  Click here for more information.
